[Dear insurance rep] We paid the other party for their damages. I have photos from the accident scene that support you were in the left lane and the other vehicle was in right lane.

L: [Dear insurance rep] -- did you have a chance to look at the pictures I already sent you? On them my car is solidly in the right lane AFTER it has been pushed LEFT by the other car.


enot: [Dear insurance rep] -- It is correct that we were on the left side of the other driver but we were completely in the right lane.
The other driver was on the right where the lane is wider to allow to enter the Gulf gas station (which is on the right side of Coney Island Ave if traveling North). He also hit the car parked at the curb on the right side in the rear; this is not mentioned in the accident report (the owner of the parked car was not present).
I witnessed this, a passenger (adult, not relative) who was in the car with us witnessed this, 2 pictures my husband sent to you show that all 3 cars were in the right lane.

As our insurance provider you should be helping us to get fair judgment on the case.

А что дальше делают? Для нас это 500$ deductible и некудот, points, штрафные очки, т.е. подорожание страховки на 5 лет. Не хотелось бы за здорово живешь становиться виноватой стороной.

Зато мы с Таней заказали себе новые купальники. Вот.
Ося написал письмо в среднюю школу главе матдепартамена. Ося вообще пишет теперь в стихах и прозе и еще рисует, убицца апстену.
А Сима, вроде, не болеет лаймом, но жалуетя на усталость, перестал сам одеваться, есть и т.п.. Трудно.

Редкое б-ство! Мне так присудили равную ответственность, когда мне, паркующейся, въехали в зад из-за угла. Пять лет с 3-мя пойнтами, но мой гад оказался адвокатом, работающем на страховую компанию. А у вас просто бруклинский мудак-генндий.

if your insurance company decides against you, you appeal. There's a board that hears all their decisions, and you actually have a pretty good chance of winning there, especially with pictures, etc.

The trick is to let them know that you are not going to give up and that you are going to appeal.

But I know how you feel: more than a year ago I was in an accident where my car was rammed from the back on a highway, and we were pushed into a car in front of us. A week later the driver that caused the whole accident started saying that I already hit the car in front by the time he hit me, and our insurance company seems to be buying into it. Or at least they were a year ago. We've sent them a letter arguing against that, and haven't heard much from them since. According to their website, the case is still open and being decided. We'll see when and how they'll decide it...

I spoke to some random person in claims dept re us being unhappy with the way our claim is being handled, explained the whole story and pointed out that in the picture both our car and the car we collided with are in the right lane, asked for supervisor, got his contact info, suggested I don't call supervisor today - may be our claims rep can revisit the case (they can't overrule her decision but she can revisit). We'll see. Hope to avoid court appeal.

the appeal is actually not directly to the court, it's to the insurance company's appeal board, which may be slightly less intimidating.

I thought we'll have to go to Brooklyn court and this idea didn't appeal to me at all.
